The New DEP Stormwater Regs: How they will shape future economic development in Pennsylvania
This briefing will focus on the new Erosion
and Sediment Control and Stormwater
Management Regulations,
which are certain to affect all commercial
and industrial activities that "move dirt."
Discussion will cover what you need to know,
including new requirements, ranging from
post construction stormwater management
plans to riparian forest buffers.
This session is a must for everyone who
attended last year's briefings on the
proposed regulations and for anyone whose
company is contemplating moving dirt for any
new expansion project.

Andrew
T. Bockis is
an associate in the Environment and Natural
Resources Practice Group of Saul Ewing where
he represents clients in matters related to
environmental regulation and policy. Mr.
Bockis brings to the firm a strong grasp of
Pennsylvania's complex environmental laws
and regulations, as well as an insider's
knowledge and perspective on how the
Commonwealth's Department of Environmental
Protection and Environmental Hearing Board
operate. Immediately prior to joining Saul
Ewing, Mr. Bockis was assistant counsel with
the Pennsylvania Department of Environmental
Protection's Bureau of Regulatory Counsel.
While there, he counseled the Department as
it assumed jurisdiction from the U.S.
Nuclear Regulatory Commission over the
regulation of most radioactive materials in
the Commonwealth. This included providing
legal advice on issues related to nuclear
safety, licensing, the medical use of
byproduct material, environmental
surveillance, and the decommissioning of
radiologically contaminated sites. He also
initiated enforcement proceedings on behalf
of the Department for violations of the
Radon Certification Act. Prior to that, Mr.
Bockis served as assistant counsel to the
Pennsylvania Environmental Hearing Board, a
position he held for more than two years. In
this capacity, he counseled the Board on
complex environmental laws and regulations
and helped judges draft opinions and
adjudications relating to oil and gas,
mining, solid and hazardous waste, and air
and water quality matters.
Adam
J. Brower, PE,
is a Partner/Project Engineer with Edward B.
Walsh & Associates, Inc., preparing residential,
commercial, and industrial subdivisions and land
development plans. He is also responsible for
engineering design of sanitary sewer, storm
drainage, roadway, water system, erosion and
sedimentation controls; preparation of quantity
and cost estimates; legal descriptions;
construction inspection and client
representation at public meetings and hearings;
and liaison with Federal, State and Local
Agencies. Mr. Brower serves as Vice President on
the Board of Directors of the Chester County
Engineers Organization, founded in 2007. It is
composed of 24 member Engineering Companies and
Municipal Engineers in Southeast Pennsylvania.
Gregory
C. Newell, PE is
the owner of Nave Newell, Inc., a land
development consulting firm in King of
Prussia. Throughout his 25 years in the
civil engineering industry, Mr. Newell has
developed a skilled proficiency at
facilitating the governmental approval and
permitting processes. He has taken a
proactive role in both informing and
educating the development community on how
to minimize the impact of the newly
implemented Erosion and Sediment Control and
Stormwater Management Regulations. He has
also made a personal commitment to bridge
the gap between the goals of the DEP while
also maintaining economic sense for
developers. Mr. Newell actively participates
in the Legislative Action Committee and
Stormwater Subcommittee for the Home
Builders Association of Chester and Delaware
Counties. He is also a member of the Chester
County Economic Development Council, Chester
County Engineers, Greater Valley Forge
Transportation Management Association and
the Montgomery County Chamber of Commerce.
Nave Newell is a Small Business (SBE) that
provides civil engineering, land surveying,
3D laser scanning/high-definition survey
(HDS), land planning and landscape
architectural services.
David
J. Raphael concentrates
his practice in administrative, civil, and
criminal environmental matters, and commercial
litigation. Mr. Raphael represents clients in
federal and state enforcement actions concerning
groundwater and surface water contamination, the
regulation of hazardous and residual waste,
storage tank compliance issues, and various
regulatory issues related to the construction
and petroleum industries. His practice also
includes counseling clients regarding
infrastructure projects and development projects
involving water supply, stormwater, and other
regulatory issues. Prior to joining Saul Ewing,
Mr. Raphael served as a Deputy Attorney General
in the Pennsylvania Office of the Attorney
General, Environmental Crimes Section. In that
position, he represented the Commonwealth in
jury trials, appellate cases, and execution of
complex criminal investigations. Additionally,
he served as Special Assistant U.S. Attorney for
the Eastern District of Pennsylvania. Mr.
Raphael is a former Assistant Counsel and
Special Assistant Counsel in the Pennsylvania
Department of Environmental Protection's Office
of Chief Counsel. In those capacities, he
represented the Commonwealth before the
Environmental Hearing Board, Commonwealth Court,
and various administrative agencies. Mr. Raphael
also negotiated agreements to reuse industrial
properties on behalf of the Commonwealth.
John
C. Snyder concentrates
his practice in the areas of land use
planning and real estate development. For
more than 30 years, he has represented
commercial, industrial, and residential
clients in the full spectrum of real estate
development and land use planning, including
land use approvals, construction contracts,
financing transactions, environmental
compliance and permitting, environmental
remediation, solid waste management, real
estate acquisition, syndication, and
community associations. He has also served
as counsel to both municipal and private
clients on golf course projects. Mr. Snyder
joined Saul Ewing in 1997 after almost 25
years of practice in a mid-sized, suburban
Philadelphia real estate firm. His real
estate experience has been diverse, touching
on such unusual areas as small issue bond
financing, permitting for sanitary landfills
and other locally undesirable land uses, and
environmental permitting for development
projects. However, his main focus has been
the representation of residential,
commercial, and industrial developments
within the Southeastern Pennsylvania region.
His clients include small and large
residential builders (including local,
regional, and national companies),
industrial and corporate park developers,
large national companies (for both corporate
headquarters and development sites), and
landowners desiring to enhance the value of
their properties for future development and
land use.
